Terms of Service

Introduction
These Terms of Service ("Terms") govern your use of festivallynx.com and its language variants (/en, /pt, /es). They are written in plain language as required by Article 14 of the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA").
By accessing or using festivallynx.com, you agree to these Terms. If you do not agree, please do not use the site.
The current version is always available at festivallynx.com/terms. The "Effective date" at the top reflects when this version took effect.

FestivalLynx is operated by Pedro José Pimenta Rodrigues as a sole trader established in Portugal. In these Terms, "FestivalLynx", "we", "us" and "our" refer to this person operating the website.
2. About FestivalLynx
FestivalLynx is a free, multilingual website for discovering and planning trips to music festivals across Europe. The service includes:
- Festival pages with dates, line-ups, ticket information and logistics
- Survival guides, accommodation guides and how-to-get-there guides
- A festival budget calculator
- A voluntary newsletter
- A feedback form
The site is available in English, Portuguese and Spanish.
FestivalLynx does not sell any service directly. We do not sell tickets, accommodation, transport, insurance or any other product. We act as a planning and discovery facilitator: we collect, organise and present information about festivals to help you get to them, and when you choose to book something we point you to the partner site that handles the transaction. We earn commission on some of those transactions (see section 6).
3. Accepting and changing these Terms
You accept these Terms by using festivallynx.com. We may update them from time to time. For material changes (for example, changes to how the service works, to your rights, or to liability), we will:
- Display a notice on the site for at least 30 days before the changes take effect
- Notify newsletter subscribers by email
- Update the "Effective date" and version number
Continued use of the site after the effective date of a change means you accept the new Terms. If you do not agree, stop using the site before the change takes effect.
4. Who can use the service
You may browse festivallynx.com at any age. Features that involve giving us your personal data — the newsletter, the budget email summary, and the feedback form — require you to be at least 16 years old.
This is set by Portuguese law (Lei n.º 58/2019, art. 16), which sets 16 as the age at which a person can give valid consent to personal data processing online. Between 13 and 16, parental authorisation is required; below 13, the law does not allow consent at all.
We do not knowingly collect data from children under 16 without parental authorisation. If you believe a child has used the site to provide personal data, contact privacy@festivallynx.com.
5. What you may and may not do
You may
- Browse all content for personal, non-commercial purposes
- Use the budget calculator to plan your own trips
- Subscribe to the newsletter
- Send feedback through the feedback form
- Share links to festivallynx.com pages
- Click through to affiliate partners to make a booking
You may not
The following uses are prohibited. This list is required by Article 14 of the DSA to be clear and unambiguous.
- Scraping and bulk extraction — using automated tools (scrapers, crawlers, bots) to extract data from the site beyond what
robots.txtpermits - Reverse engineering — decompiling, disassembling or attempting to derive the source code of any part of the site
- Interfering with security — bypassing, disabling or attempting to defeat any security feature, access control, rate limit or technical protection
- Misleading impersonation — pretending to be FestivalLynx, a partner or another user
- Misuse of forms — submitting spam, advertising, malicious code, or content unrelated to festivals through the feedback form or any other input
- Unlawful use — using the site in any way that violates Portuguese law, EU law or the laws of your country
- Commercial republishing — republishing or reselling FestivalLynx content (festival pages, guides, calculator results) for commercial purposes without our written permission
- Removing notices — removing or altering copyright notices, attribution or other proprietary markings
Enforcement
We act in a diligent, objective and proportionate manner when enforcing these restrictions, as required by Article 14(4) of the DSA. We may:
- Block requests that violate technical protections (rate limits, automated abuse detection)
- Block IP addresses or networks involved in scraping or attack patterns
- Disregard feedback submissions that are spam or unrelated to festivals
We do not host user-generated content that is publicly disseminated, so we do not operate a content moderation system in the sense covered by DSA Chapter III, Section 3.
6. Affiliate links and commissions
FestivalLynx is funded by affiliate commissions. When you click certain links or interact with certain widgets on the site and complete a booking on the partner site, the partner pays us a commission. Commission does not increase the price you pay.
Our current affiliate partners are:
- Stay22 — for accommodation suggestions in our blog accommodation guides
- Travelpayouts — an affiliate network covering a range of travel-related services such as transport, accommodation and ticketing, through its participating merchants
We choose which partners to feature based on coverage and editorial fit, not just commission rate. Our recommendations are based on what we believe is useful for the trip; commission does not change which festivals or services we cover.
We may add or change affiliate partners. When we do, we will update this section and the Privacy Policy.
7. Service availability and accuracy
Availability
We aim to keep festivallynx.com available, but we do not guarantee uninterrupted service. The site may be unavailable for maintenance, updates, technical issues or events outside our control.
Accuracy of festival information
We make reasonable efforts to keep festival data (dates, line-ups, venues, prices, accessibility information) accurate and up to date. However, that is not always possible due to:
- Organisers change festival details, sometimes at short notice
- Tickets sell out, sales open and close, prices fluctuate
- Accommodation availability and prices change in real time
- Festivals are cancelled, postponed or relocated
You should always verify critical details directly with the festival organiser, ticket vendor, accommodation provider or transport operator before booking, travelling or making non-refundable commitments. FestivalLynx is an information and planning resource; it is not the entity setting the prices and conditions you may encounter during your trip or festival experience.
Calculator and budget estimates
The festival budget calculator produces estimates based on the data you provide and our research. Actual costs will vary. The calculator is a planning tool, not a guarantee of price.
8. Your responsibilities
FestivalLynx is a planning aid. The information we publish — festival pages, guides, calculator outputs, recommendations — exists to help you make better decisions, not to make decisions for you.
When you use the site, you are responsible for:
- Verifying critical details with the primary source (festival organiser, ticket vendor, transport operator, accommodation provider) before you book, pay or travel
- Your own safety at festivals and during travel, including checking weather, local conditions, vaccination requirements, visa requirements and travel insurance where relevant
- Applying common sense to recommendations — a calculated budget is an estimate, an accommodation suggestion is a starting point, a "best time to arrive" tip is an average expectation
- Complying with local law in your destination country and with the rules set by festival organisers, transport operators, accommodation providers and other partners
- Your own bookings and commitments once made, including cancellations, refunds and rebookings; these are governed by the partner's terms, not ours
Treat FestivalLynx as a starting point for your planning, not the final authority on any festival, route, accommodation or budget.
9. Intellectual property
Our content
The festivallynx.com site, including its design, text, images, code and the structure of the festival information we publish, is owned by Pedro José Pimenta Rodrigues or licensed for our use. This is protected by Portuguese copyright law (Código do Direito de Autor e dos Direitos Conexos) and EU intellectual property law.
You may:
- View and use the content for personal, non-commercial purposes
- Quote short passages with attribution and a link back to the source page
- Share links to our pages on social media or in private communications
You may not:
- Republish our content in full or substantially on another site
- Use our content to train commercial AI models without written permission
- Use our brand name, logo or visual identity to imply endorsement or partnership
Third-party content
Festival names, organiser names, artist names, venue names and event logos belong to their respective owners. We use them for editorial reference under fair-use principles and applicable trademark exemptions.
Photography and other media on the site is either ours, licensed, or used with attribution as the source requires.
Your content
When you send feedback through the feedback form or by email, you give us permission to read, store and use that feedback to improve the service. We do not publish your feedback as user-facing content on the site.
10. Third-party links and embedded content
festivallynx.com contains links to third-party sites (booking partners, festival organisers, ticket vendors, transport operators, accommodation providers) and embedded third-party widgets (currently the Stay22 accommodation widget).
We do not control these third parties. We are not responsible for:
- Their content, accuracy or availability
- Their privacy practices
- Their terms of use
- Any transaction you enter into with them
When you click through to a third-party site or interact with an embedded widget, your relationship is with that third party, governed by their terms and privacy policy.
11. Privacy and cookies
How we handle personal data is described in our Privacy Policy and our Cookie Policy. By using the site, you acknowledge those documents.
12. Disclaimer
festivallynx.com is provided "as is" and "as available". To the maximum extent permitted by law, we do not warrant that:
- The site will be uninterrupted, error-free or secure
- Festival data, calculator outputs or guide information will be accurate, complete or current
- Any partner site, booking, accommodation or transport service will be available or perform as expected
- Defects in the site will be corrected
This disclaimer does not exclude or limit any right you have under Portuguese consumer protection law that cannot be excluded or limited by contract.
13. Limitation of liability
To the maximum extent permitted by Portuguese law, our liability to you is limited as follows.
We are not liable for:
- Losses arising from your reliance on festival data, calculator outputs or guide information
- Losses arising from third-party services you book or transactions you enter into through affiliate links
- Indirect, consequential or incidental losses
- Losses arising from temporary unavailability of the site
Portuguese law does not allow us to contractually disclaim certain types of responsibility, and we don't try to. Where one of the following happens because of us, the limits above do not apply:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation by us
- Gross negligence or wilful misconduct
- Any liability that cannot be excluded or limited under Portuguese law (Decreto-Lei n.º 446/85 on standard contractual clauses, Decreto-Lei n.º 67/2003 on consumer rights, and other applicable consumer protection laws)
If a court finds that any limitation above is unenforceable, the limitation will apply to the maximum extent permitted by law and the rest of these Terms will remain in effect.
14. Suspension and blocking
We may block your access to the site (for example, by blocking an IP address or a network) if:
- You breach these Terms
- Your use causes technical disruption to the service
- We are required to do so by law
Blocking is a last-resort measure. We apply it proportionately and only for as long as necessary.
15. Governing law and disputes
These Terms are governed by Portuguese law.
If you are a consumer resident in Portugal, you can also rely on mandatory consumer protection rules of Portuguese law that cannot be excluded by contract.
If you are a consumer resident in another EU country, you can also rely on mandatory consumer protection rules of the law of your country of residence, in accordance with Article 6 of Regulation (EC) 593/2008 (Rome I).
Out-of-court dispute resolution
Before bringing a court action, we encourage you to contact us at pedro@festivallynx.com. Most issues can be resolved by direct communication.
If we cannot resolve the matter directly, you may:
- Use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
- Refer the matter to the Portuguese consumer dispute resolution centre that covers our area (Centro de Arbitragem de Conflitos de Consumo de Coimbra). A list of recognised centres is available at www.consumidor.gov.pt
Courts
Subject to mandatory rules of jurisdiction in your favour as a consumer, the courts of Coimbra, Portugal have non-exclusive jurisdiction over any dispute arising from or in connection with these Terms or your use of the site.
